By using The Business Analysts’ Group services and by accepting the services provided to you by The Business Analysts’ Group, you expressly agree to these standard terms and conditions (hereinafter referred to as the "Terms").

1. Provision of the Services:

All of The Business Analysts’ Group's services are provided under these Terms. The Business Analysts’ Group reserves the right to add, modify or discontinue any of its services or its features temporarily or permanently, without notice to you and without liability to you. The Business Analysts’ Group reserves the right to add to or change these Terms at any time, which shall be notified to you by The Business Analysts’ Group posting of such revised Terms on the site through which the services are provided. You will be deemed to have accepted any change if you make an enquiry after the revised Terms have been posted.

Once you have submitted an online order form giving details of your enquiry, you will be contacted by The Business Analysts’ Group to request any additional information, if necessary, and to provide a cost estimate and/or to confirm that the service can be carried out according to your specifications. A contract with you for an individual research project subject to these Terms will come into effect when you have confirmed to The Business Analysts’ Group that it may proceed with the research project specified in the order form at the fee mutually agreed between us. The Business Analysts’ Group will advise you prior to exceeding any initial fee estimate that is given to you, and any additional charges will be subject to your approval. If you do not so approve of any additional charges exceeding the initial fee estimate, you will be entitled to terminate such research project.

2. Your Obligations

You agree to provide accurate, current, and complete information to us when requested by The Business Analysts’ Group and to inform us promptly of any changes. You also agree that: (a) you will not attempt to obtain unauthorized access to our service; (b) you will not copy or disseminate any research project you receive from The Business Analysts’ Group hereunder to any third party, and you will not use any such research project for any purpose except for your own personal use; (c) you will comply with all applicable local, state, national, and international laws and regulations, including, without limitation, those related to privacy and data collection.

3. Emails

All research projects provided by The Business Analysts’ Group shall be sent to you at such Email address notified by you in a timely fashion. The Business Analysts’ Group shall not be responsible for non-delivery of Emails arising from your failure to notify us of a valid Email address. If on registration (or on amendment of your registration details) you provide The Business Analysts’ Group with an email address then you are expressly warranting that you are entitled to receive emails at that address. You also agree that The Business Analysts’ Group may refrain from sending you any emails to such address without notifying you, even if you have subscribed to receive them, if we receive a request from your employer, school or other party to stop sending emails to that address.

4. Editing

The Customer may not edit, cut, alter, superimpose, adapt, add to or take from any report without the consent of The Business Analysts’ Group and The Business Analysts’ Group shall not be responsible for any such modification.

5. Payment

Subject to your approval of the cost for any research project submitted by email to The Business Analysts’ Group, you authorize The Business Analysts’ Group to debit your credit card account, the details of which you will provide to The Business Analysts’ Group when requested. You agree to pay all amounts charged to your credit card, including applicable sales tax, which are specified by The Business Analysts’ Group at the time of the transaction, and any further charges as authorized by you from time to time.

6. Proprietary Rights

The Business Analysts’ Group services and the site on which they are provided contain copyrighted material, trademarks and other proprietary information, including without limitation text, software, photos, video, graphics and/or sound, some of which are owned and/or controlled by The Business Analysts’ Group or the company who owns and/or controls the site. You may download and/or use such material for your personal use only and you acknowledge that you shall not acquire any ownership rights by downloading and/or using such materials. Copying, redistributing, re-transmitting, publishing or exploiting any such materials is strictly prohibited without the prior written consent of The Business Analysts’ Group.

You agree to assign any such rights which may vest in you at any time to The Business Analysts’ Group.

7. No Warranties

The research provided is only for your general information and use. In particular, the research does not constitute any form of advice, recommendation or arrangement by The Business Analysts’ Group and is not intended to be relied upon by users in making (or refraining from making) any specific investment or other decisions. Appropriate independent advice should be obtained before making any such decision. Any arrangements made between you and any third party named on this Site or whose contact details are otherwise provided to by The Business Analysts’ Group at your sole risk and responsibility.

All representations, conditions, warranties and terms relating to The Business Analysts’ Group software and The Business Analysts’ Group services and any other software or services provided or performed by The Business Analysts’ Group (whether statutory or otherwise, and including, without limitation, any as to the fitness for a particular purpose, satisfactory quality or merchantability of any thereof) are hereby excluded by The Business Analysts’ Group to the fullest extent permitted by law. You hereby agree that The Business Analysts’ Group services and any research project or other materials you receive are provided "as is", "with all faults" and "as available" and are without warranty of any kind. The Business Analysts’ Group shall not at any time be liable for any claims or losses of any nature, including but not limited to lost profits, punitive or consequential damages. In addition to the foregoing, The Business Analysts’ Group does not provide any warranty against infringement or of title or quiet enjoyment and makes no express warranties.

You covenant not to sue The Business Analysts’ Group, its partners and associates in connection with the Research and the materials provided hereunder for any reason, and you agree to indemnify, defend and hold the other harmless from and against all costs, claims, expenses and liabilities arising in connection with any action, claim, demand or allegation which, if proven, would show a breach of your obligations, warranties, representations and undertakings hereunder, or relating to your use of the services or the site, including without limitation any claims that your use of the material violates the intellectual property rights of any third parties.

Some of the links provided by The Business Analysts’ Group in connection with the services, or provided in connection with the site will provide you access to other sites, which are not under the control of The Business Analysts’ Group, its partners or associates. You acknowledge and agree that The Business Analysts’ Group does not assume any responsibility or liability for any information, content, communications and/or materials available on such third-party sites. You understand that The Business Analysts’ Group provides such links for your convenience only and does not endorse any third party sites or the persons, which control them.

9. Failure to Meet Customer Satisfaction

The Business Analysts’ Group will use its reasonable endeavors to meet the timeframes provided in the estimate sent to you, and to provide the services to a high standard of quality as would be customarily understood in the industry. Should any research project provided by The Business Analysts’ Group to you fail to meet such standard of quality in your reasonable opinion, you agree that your sole remedy shall be for The Business Analysts’ Group to repeat the services free of charge, which The Business Analysts’ Group shall endeavor to provide upon receipt of your notification to The Business Analysts’ Group clearly setting out the reasons which you believe the services failed to meet the standard. Notwithstanding the foregoing, The Business Analysts’ Group shall not be responsible to provide such repeat services for any failure by you to provide clear, accurate information in the request you submit.

10. Privacy

The Business Analysts’ Group will collect your personal data in order to provide the services to you. The Business Analysts’ Group takes all reasonable precautions to ensure that your personal information is adequately guarded against unauthorized access or release. The Business Analysts’ Group will not give, sell, rent or loan any identifiable personal information to any third party, unless legally required to do so to government authorities or to the courts. However, The Business Analysts’ Group may share non-personal, summary, or aggregate customer data with investors and other third parties. The Business Analysts’ Group may email you regarding The Business Analysts’ Group or its partners' services or offers. However, if you do not wish to receive such information, you may notify The Business Analysts’ Group.

11. Entire Agreement

These terms and conditions contains the entire understanding of the parties relating to the subject matter hereof and supersedes any previous or other existing arrangements, agreements or understandings between the parties in relation to the subject matter hereof.

12. Notices

All notices must be in writing and delivered by hand or sent by first class post to the party at its respective address and shall if delivered by hand be deemed served at the time of delivery or if by post be deemed served on the third day after first class recorded delivery posting (providing proof of posting is retained).

13. Assignment

You may not assign or transfer your rights and obligations under these standard terms and conditions without prior written approval from The Business Analysts’ Group. The Business Analysts’ Group may freely assign or transfer its rights and obligations under these standard terms and conditions without notice to you.

14. Force Majeure

The Business Analysts’ Group shall in no event be responsible for any delay or failure in performance resulting directly or indirectly because of circumstances beyond its reasonable control.

15. No Partnership

Nothing in this Agreement creates or shall be deemed to have created a partnership or a contract of employment or an agency agreement between The Business Analysts’ Group and you.

16. Severability

In the event that any provision of these standard terms and conditions shall be held to be unenforceable or against public policy pursuant to a final adjudication by a court of competent jurisdiction such provision shall be severed here from and the remainder of these standard terms and conditions shall be deemed in full force and effect.

17. Waiver

A waiver by either party of any of the terms and conditions set out hereunder or any part thereof shall not be deemed to be a waiver of any other part of these standard terms and conditions or of any later breach of these standard terms and conditions or any part thereof.

18. Law

These standard terms and conditions shall be governed by and read and construed in accordance with the laws of New Delhi, India and the parties hereto submit to the non-exclusive jurisdiction of the High Court of Delhi for the settlement of any disputes arising.
